SIR,—In view of the recent damages awarded against the Sheffield fertility clinic which succeeded in providing a woman with triplets when she desired only one or two children, I would like to ascertain who would be responsible for paying such damages if a woman became pregnant having taken emergency hormonal contraception supplied by a pharmacist under a patient group direction.
What would be the situation if the woman claimed she was not fully aware of the high failure rate of such contraception? Would any damages awarded against the pharmacist be met by the health authority responsible for the PGD or by the pharmacist's own indemnity insurance ?
