Guidance on fitness-to-practise changeover

Guidance has been prepared by the Royal Pharmaceutical Society on transitional arrangements for the changeover to the new fitness-to-practise machinery that comes into force on 30 March through Rules made under the Pharmacists and Pharmacy Technicians Order 2007 (see p227).

The guidance (see p230) says that allegations referred to the Statutory Committee before 30 March will be considered in accordance with the current Rules. If the chairman has ordered an inquiry and a date has been fixed, then the Statutory Committee will hold the inquiry. If a date has not been fixed, then the new Disciplinary Committee will hold an inquiry under the current Rules.

Allegations that have not been referred to the Statutory Committee by 30 March, and all new allegations after that date, will be considered under the new Rules by the Disciplinary Committee or the Health Committee.

All applications for restoration to the register after a striking-off will be considered by the Disciplinary Committee under the new Rules.
