Legal attempt to halt Pfizer's direct supply arrangements

Eight pharmaceutical wholesalers are to seek a High Court injunction against Pfizer's sole-distributor agreement with UniChem before it comes into effect on 5 March 2007.

As The Journal went to press, an application for an interim injunction was expected to be heard on 2 March. The eight wholesalers are taking this step because the Office of Fair Trading has said that it will not have made a decision on whether Pfizer’s scheme raises competition concerns before it starts.

BAPW executive director Martin Sawer said: “We are disappointed with the OFT. We had hoped that the regulator or the Department of Health would have expressed a view by 5 March.”
