Lloydspharmacy escapes paying damages

Lloydspharmacy could escape having to pay damages to US lawyer Cathy Horton, who sued the company after suffering ill-health caused by an excessive dose of steroids (PJ, 18 November 2006, p595).

Ms Horton, who had claimed £5m, was awarded £1,435,949.58 by High Court judge Mr Justice Keith earlier this month. She might receive nothing because she has already reached an out-of-court settlement for £1.5m with her doctor’s insurer, leaving Lloydspharmacy having to pay her less than she has already received. Who will have to pay the costs of the case has yet to be decided.
