Council decision on how to handle certain health-related cases
New procedures for the Society's handling of drink-drive convictions were agreed by the Council of the Royal Pharmaceutical Society at the March
Council meeting. The Council also agreed that health-related cases that have been heard by the Statutory Committee should be reviewed to assess current risk.
The Council made its decisions on the recommendation of the Law and Ethics
Committee, which had considered the matters in the light of the Society’s
health jurisdiction under the Pharmacists and Pharmacy Technician Order
2007.
In the case of drink-driving convictions, the Council agreed that all
such convictions should be referred to the new Investigating Committee.
In the case of a one-off conviction, the Society would not obtain a medical
report before referral. Instead, the Investigating Committee would determine
whether a medical report needed to be commissioned after considering
the information presented to it. If a registrant received a second drink-drive
conviction within three years, the Society would obtain a medical report
from an appointed medical assessor before referring the case to the Investigating
Committee.
On the matter of cases already heard by the Statutory Committee in which
health had been raised as a concern, the Council agreed that such cases
should be reviewed and risk-assessed. The Society would write to the
individuals concerned to enable an assessment to be made of the current
health situation. A report of the health element of the case would be
sent to the Investigating Committee for consideration, supported by a
medical report provided by a medical assessor or other appropriate medical
practitioner approved by the Society.
