Statutory Committee decisions

Set out below are the outcomes of recent inquiries heard before the Statutory Committee of the Royal Pharmaceutical Society of Great Britain.

On Tuesday 16 March 2004, in the new inquiry into the case of Mount Shilo Trading UK Ltd, of 797 Harrow Road, Kensal Green, London NW10, the committee, having found the conviction and the alleged misconduct proved, directed that the company be disqualified for the purposes of Part IV of the Medicines Act 1968 without limitation of time. Section 82 of the Medicines Act 1968, provides that a direction under Section 80 shall not take effect until the end of the period of three months from the date on which notice of the direction is given to the body corporate or other person to whom it relates, and if an appeal against the direction is brought under this section, shall not take effect until that appeal has been determined or withdrawn.

On Wednesday 17 March 2004, in the new inquiry into the case of Derek Christopher Sukhdeo, of Flat 3, Falcon Brook Mansions, 262 Balham High Road, London SW17, the committee, having found the allegations of misconduct proved, resolved to issue a reprimand.

In the new inquiry into the case of John Edward Bradbeer, of “Mill Bank”, Ashington Road, Ellington, Morpeth, Northumberland, and R. Hindhaugh (Chemists) Ltd, of 8 Laburnum Terrace, Ashington, Northumberland, the committee, having found the allegations of misconduct proved, resolved to issue a reprimand to Mr Bradbeer and in relation to the company determined to make no direction.

On Thursday 18 March 2004, in the new inquiry into the case of Rajnikant Jashbhai Patel, of 2 Staplehurst Road, Hither Green, London SE13, the committee, having found the allegations of misconduct proved, resolved to direct the Registrar to remove Ms Patel’s name from the Register of Pharmaceutical Chemists. Under Section 11 of the Pharmacy Act 1954, this direction is not to take effect until the expiration of a period of three months from the date on which notice of removal is given or in a case where an appeal has been brought against the direction, until the appeal is determined or withdrawn.
