Alterations to the Byelaws: Annual Register of Pharmaceutical Chemists and fees payable to the Society

Notice is hereby given in accordance with Section XXVIII of the Byelaws that the Council of the Society has approved proposals to alter the Byelaws concerning the Annual Register of Pharmaceutical Chemists (Third Schedule) and the fees payable to the Society (Fourth Schedule) as hereunder and that it intends to make such alterations after the expiry of 60 days from the date of this notice, subject to such amendments as the Lords of the Privy Council may require.

Third Schedule
The definition of a practising pharmacist, as set out in the third Schedule to the Byelaws shall be amended as follows:

“* a practising pharmacist is a member who undertakes any work in, or gives advice in relation to, the practice of pharmacy or healthcare.”

Fourth Schedule
The fourth Schedule to the Byelaws shall be deleted in its entirety and replaced as follows —

FOURTH SCHEDULE: FEES PAYABLE TO THE SOCIETY

Annual retention fee
1. The annual retention fee payable by a member in accordance with Section II(2) of these Byelaws shall be as follows —
(a) pharmacists practising in England, Scotland or Wales, shall pay a retention fee of £267;
(b) pharmacists practising outside England, Scotland or Wales —
(i) who are not registered with the authority responsible for the regulation of pharmacy in the jurisdiction in which they are practising, or
(ii) who are required by local law or practice to be registered with the Society in order to practise within that jurisdiction,
shall pay a retention fee of £267;
(c) pharmacists outside England, Scotland or Wales —
(i) who are registered with an authority responsible for the regulation of pharmacy in any jurisdiction outside England, Scotland or Wales, and
(ii) who are not required by local law or practice to be registered with the Society in order to practise within that jurisdiction,
shall pay a retention fee of £106;
(d) non-practising pharmacists who are resident in England, Scotland or Wales, and who have been continuously registered with the Society for a period of fifty years or more, shall pay a retention fee of £20; and
(e) non-practising pharmacists who are resident in England, Scotland or Wales, and who have not been continuously registered with the Society for a period of fifty years, shall pay a retention fee of £60.

Upgrade fee
2. The fees payable in respect of any pharmacist who wishes to upgrade his registration status within the period covered by the retention fee already paid, shall be as follows —
(a) pharmacists who have paid the retention fee specified in paragraph 1(c) and who —
(i) wish to practise in England, Scotland or Wales, or
(ii) are subsequently required to register with the Society in order to practise in another jurisdiction,
shall pay an additional fee of £161;
(b) pharmacists who have paid the retention fee specified in paragraph 1(d) who wish to upgrade to practising status shall pay an additional fee of £247;
(c) pharmacists who have paid the retention fee specified in paragraph 1(e) who wish to upgrade to practising status shall pay an additional fee of £207;
(d) pharmacists who have paid the retention fee specified in paragraph 1(d) and who —
(i) subsequently wish to practise outside England, Scotland or Wales, and
(ii) meet the requirements of paragraph 1(c),
shall pay an additional £86; and
(e) pharmacists who have paid the retention fee specified in paragraph 1(e) and who —
(i) subsequently wish to practise outside England, Scotland or Wales, and
(ii) meet the requirements of paragraph 1(c),
shall pay an additional £46.

Restoration fee
3. (1) Subparagraph (2) below, shall not apply to any pharmacist —
(a) whose name was removed from the Register, during the period 1 December 2004 and 6 April 2005; and
(b) whose name was removed upon his own request, or for non payment of the retention fee; and
(c) who, in the period immediately prior to the removal of his name from the register, was practising outside England, Scotland or Wales; or
(d) who, prior to the removal of his name from the register, had been continuously registered with the Society for more than fifty years.
(2) The fee payable by any person whose name has been removed from the register —
(a) for non payment of the annual retention fee; or
(b) following a direction issued by the Society’s Statutory Committee,
and who applies to the Society to have his name restored to the register, shall be £509.

4. (1) Subparagraph (2) below, shall not apply to any pharmacist —
(a) whose name was removed from the Register, during the period 1 December 2004 and 6 April 2005; and
(b) whose name was removed upon his own request, or for non-payment of the retention fee; and
(c) who, in the period immediately prior to the removal of his name from the register, was practising outside England, Scotland or Wales; or
(d) who, prior to the removal of his name from the register, had been continuously registered with the Society for more than fifty years.
(2) A person whose application for the voluntary removal of his name from the register is accepted by the Society, and who then subsequently applies to the Society to have his name restored to the register, shall pay an application fee of £125.

5. Any person whose name is restored to the register shall pay, in addition to any fee they may be required to pay in accordance with paragraph (3) or (4) above, the annual retention pay specified in paragraph (1)(a)-(e).

Application fee for recognition as a supplementary prescriber
6. Any pharmacist applying to be recognised as a Supplementary Prescriber shall pay an application fee of £35.

Application fee for registration of overseas pharmacists under reciprocal arrangements
7. The application fee for registration pursuant to an agreement entered into in accordance with the provisions of Section XIX (1) and (3) of these Bylaws shall be £129.

Fees for persons wishing to registered under the Pharmacy Act 1954
8. The application fee for registration in accordance with the provisions of Section XIX (5) and XIX (6)(e)(iii) of these Byelaws shall be £129.

9. The fees payable in respect of Section XIX (6)(e)(i) and (ii) of these Byelaws shall be as follows —
(a) the fee for examination of evidence shall be £595; and
(b) the fee for inquiry before, and interview by, the Adjudicating Committee shall be £595.

Application fee for registration by persons having completed preregistration training within Great Britain
10. The fee for applications pursuant to Section XX (3) of these Byelaws shall be £129.

Fees in respect of preregistration training
11. The fees payable in respect of Section XX (21)(b) of these Byelaws shall be £144.

12. The fees payable in respect of Section XX (26) of these Byelaws shall be as follows —
(a) the examination fee shall be £170;
(b) the late entry fee shall be £340;

13. The fees payable in respect of Section XX (27) of these Byelaws shall be as follows —
(a) the examination resit fee shall be £170;
(b) the late entry fee shall be £340.

Explanatory Note
(1) The amount of fees, and new categories of fee, set out in the amended fourth Schedule were determined by the Council at its meeting on 2 and 3 August 2005.
