Statutory Committee Inquiries
The Statutory Committee will meet at the Royal Pharmaceutical Society of Great
Britain, 1 Lambeth High Street, London SE1, at 9.30am on Monday 19 September,
Tuesday 20 September, Wednesday 21 September and Thursday 22 September 2005 to
hear the following inquiries:
Monday 19 September
1. An inquiry into a complaint by the Council of the Society against Derek
Michael Phillips (registration number 75766) which alleges that discrepancies
in Viagra stock; breaches of Regulation 19 the Misuse of Drugs Regulations,
Regulation 6 of the Medicines Sale and Supply Miscellaneous Provisions Regulations
1980 and the Misuse of Drugs Safe Custody Regulations; a failure to deal
appropriately with Controlled Drugs and patient returns; and the supply of
four tablets of sildenafil where there was no valid prescription in existence
at the time of supply, may amount to misconduct.
2. The committee will resume consideration of an inquiry into the case of Rajiv
Sarna (registration number 76820) who has been convicted of five offences contrary
to the Road Traffic Act 1988. The committee will then hear a new inquiry into
a complaint by the Council of the Society against Mr Sarna and Sarna Enterprises
Ltd (identification number 1084216) which alleges that inappropriate sales
of codeine linctus to members of the public; a failure to ensure that non-pharmacist
members of staff received any adequate training regarding the sale or supply
of medicines and/or a failure to provide such staff with specific instructions
regarding the sale of pharmacy medicines, including codeine linctus; a failure
to ensure that his knowledge was of a high quality and up to date; and his
admission that he was not aware of the responsibilities of a superintendent
pharmacist, may amount to misconduct.
Tuesday 20 September
3. An inquiry into a complaint by the Council of the Society against John
Joseph George Barnes (registration number 62087) which alleges that a dispensing
error and dismissive response following the said error; a failure to contact
the prescriber to ensure that what was being called for was clear and unequivocal;
and a failure to record the dispensing error, may amount to misconduct.
4. An inquiry into a complaint by the Council of the Society against Paul
Crawford (registration number 92425) which alleges that the consumption of diazepam
tablets that did not belong to him and had not been prescribed for him and
the consumption of temazepam tablets which had been prescribed for another
may amount to misconduct.
Wednesday 21 September
5. The committee will resume consideration of an inquiry into a complaint by
the Council of the Society against Sanjay Janubhai Patel (registration number
76827) which alleged that a number of dispensing errors may amount to misconduct.
6. The committee will resume consideration of an inquiry into a complaint by
the Council of the Society against Rajesh Chaganbhai Mistry (registration number
91540) and House of Mistry Ltd (identification number 1084647) concerning allegations
of obtaining payment from the Prescription Pricing Authority in respect of
repeat prescriptions that had not been requested or required by the patient
and which were not dispensed, and prescriptions wrongly endorsed with small
pack sizes when larger sizes had been dispensed, may amount to misconduct.
Thursday 22 September
7. The committee will resume consideration of an inquiry into a complaint by
the Council of the Society against Lesley Day (registration number 68404)
which alleges that the theft of medicines from a pharmacy; the consumption
of stolen medicines while on duty at a pharmacy; the commission of a dispensing
error; and inappropriate behaviour while on duty at a pharmacy, may amount
to misconduct.
