Statutory Committee inquiries

The Statutory Committee will meet at the Royal Pharmaceutical Society of Great Britain, 1 Lambeth High Street, London SE1, at 9.30am on Monday 20 March, Tuesday 21 March, Wednesday 22 March and Thursday 23 March 2006 to hear the following inquiries:

Monday 20 March
1. The committee will resume its inquiry into a complaint by the Council of the Society against John Brian Price (registration number 54597) which alleges that a failure to provide the best possible health care to a patient; a failure to adhere to accepted standards of professional conduct and engaging in behaviour likely to undermine public confidence in the profession; and the use of a SCENAR [self-controlled energo neuro adaptive regulation] device, despite having no training or accreditation in the use of complementary therapies for the treatment of facial infections, may amount to misconduct.

2. The committee will resume its inquiry into a complaint by the Council of the Society against Maria Mariscal Navarro (registration number 1078456) and Andrew Murdock (registration number 73499) which alleges that a labelling error and failure to deal appropriately with a complaint concerning the error, may amount to misconduct.

Tuesday 21 March
3. An inquiry into a complaint by the Council of the Society against Michael Turner (registration number 67819) which alleges that the unlawful possession of Controlled Drugs; the possession of quantities of prescription-only medicines at his home; a failure to make entries in the Controlled Drugs register in respect of methadone and amphetamine purchases and supplies; the unlawful supplies of methadone and/or diazepam; and providing false information to police officers, may amount to misconduct. The committee will also consider convictions for various driving offences; two counts of the supply of class A Controlled Drugs contrary to Section 4(1) of the Misuse of Drugs Act 1971; three counts of the supply of Class C Controlled Drugs contrary to section 4(1) of the Misuse of Drugs Act 1971; and one count of possession of a Class B Controlled Drug contrary to section 5 (3) of the Misuse of Drugs Act 1971.

Wednesday 22 March
4. The committee will deliver the determination of the inquiry into a complaint by the Council of the Society against Maysa Jibreel Al-Natsheh (registration number 90768) and Preston Park Chemists Ltd (identification number 1087052) which alleged that a failure to ensure that the pharmacist in charge had the requisite knowledge, skills and fitness to perform the work delegated to him; a failure to ensure that he was sufficiently competent in English; a failure to ensure that he was properly informed of the professional duties he was expected to undertake; a failure to supervise and support the pharmacist in charge; and a failure to exercise proper control over the business, may have amounted to misconduct.

5. The committee will resume its inquiry a complaint by the Council of the Society against Derek Michael Phillips (registration number 75766) which alleges that discrepancies in stocks of Viagra 50mg and 100mg; breaches of Regulation 19 of the Misuse of Drugs Regulations; breaches of the Misuse of Drugs (Safe Custody) Regulations; a failure to deal appropriately with Controlled Drugs (failure to segregate patient returns and date-expired stock); the supply of sildenafil without a valid prescription; breaches of Regulation 6 of the Medicines (Sale and Supply) (Miscellaneous Provisions) Regulations 1980; and the condition of the pharmacy notwithstanding a warning from the Society inspector, may amount to misconduct.

Thursday 23 March
6. The committee will resume the inquiry into a complaint by the Council of the Society against John Joseph George Barnes (registration number 62087) which alleges that a dispensing error; a failure to contact the prescriber for clarification; the dismissive response to the error; a failure to keep an accurate record in the patient medication record; and a failure to record the error, may amount to misconduct.
