Statutory Committee inquiries

The Statutory Committee will meet at the Royal Pharmaceutical Society of Great Britain, 1 Lambeth High Street, London SE1, at 9.30am on Monday 22 May, Tuesday 23 May, Wednesday 24 May and Thursday 25 May 2006 to hear the following inquiries:

Monday 22 May 2006
1. The committee will resume the inquiry into a complaint by the Council of the Society against Manherlal Keshavlal Shah (registration number 63471) and MAM International Ltd (identification number 1001688) which alleges that the supply of out-of-date medicines; the supply of enalapril tablets on which there was no expiry date or batch number; a failure to implement adequate systems for the removal of out-of-date medicines; the presence in the dispensary of medicines where the date of expiry and batch number were not present and/or had been removed; the presence in the dispensary of medicines labelled years previously from other pharmacies for various patients which were stored among the other, alphabetically arranged, current stock, indicating that they might be reused; and the presence of a number of European products which did not bear a product licence number, may amount to misconduct.

Tuesday 23 May 2006
2. An inquiry into a complaint by the Council of the Society against Dinesh Parmar (registration number 74869) which alleges that the repeated supply of laxatives and/or diuretics to a patient whom Mr Parmar knew, or ought to have known, was vulnerable to abuse of those medicines; a failure to ensure that the pharmacy premises were safe for the public and/or persons working there; a failure to ensure that all stock was stored appropriately; and a failure to heed the advice of a Society inspector, may amount to misconduct. The committee will also consider the following convictions: the supply of a medicinal product, namely frusemide, without a prescription given by an appropriate practitioner, contrary to s58(2)(a) and s67(2) of the Medicines Act 1968; the supply of a medicinal product, namely frusemide, in a container not labelled identifying the contents and giving direction as to use, contrary to s85(3) and 91(2) of the Medicines Act 1968; the sale of five ampoules of diamorphine 10ml, a medicinal product which was not of the nature of quality demanded by the purchaser in that it was out of date, contrary to s64(1) of the Medicines Act 1968.

Wednesday 24 May 2006
3. An inquiry into a complaint by the Council of the Society against Lyndon Lien Sun Wou (registration number 67470) which alleges that the use of abusive and threatening language and behaviour towards two assistants and the failure to deal appropriately with a patient’s request to dispense her medicine, may amount to misconduct.

Thursday 25 May 2006
4. The committee will consider an application for restoration on behalf of Piyush Patel (previous registration number 76075).

5. An inquiry into a complaint by the Council of the Society against Ruxana Munshi (registration number 82341) which alleges that the erroneous certification of prescription forms by Ms Munshi and/or her employees; the submission of these erroneously certificated prescription forms to the Prescription Pricing Authority for payment resulting in overpayment; and the failure to ensure that staff had the requisite knowledge, skills and fitness to perform work delegated to them, may amount to misconduct.
