Statutory Committee inquiries

The Statutory Committee will meet at the Royal Pharmaceutical Society of Great Britain, 1 Lambeth High Street, London SE1, at 9.30am on Monday 26 June, Tuesday 27 June, Wednesday 28 June and Thursday 29 June 2006 to hear the following inquiries.

Monday 26 June 2006

1. The committee will resume the inquiry into a complaint by the Council of the Society against Richard Gregory Woodroffe (registration number 68919), Margaret Mary Rita Gorman (registration number 67793) and Alan Woodcock Ltd (company identification number 1001329), which alleges that a dispensing error involving the supply of 100 Celance 1mg tablets against a prescription for 200 Pergolide 50µg tablets may amount to misconduct.

2. The committee will deliver the determination of the inquiry into the case of Dinesh Parmar (registration number 74869). A complaint by the Council of the Society alleged that the repeated supply of laxatives and/or diuretics to a patient whom Mr Parmar knew or ought to have known was vulnerable to abuse of those medications, a failure to ensure that the pharmacy premises were safe for the public and/or persons working there, a failure to ensure that all stock was stored appropriately, and a failure to heed the advice of a Society inspector may have amounted to misconduct. The committee also considered the following convictions: the supply of a medicinal product, namely frusemide, without a prescription given by an appropriate practitioner, contrary to Sections 58(2)(a) and 67(2) of the Medicines Act 1968; the supply of a medicinal product, namely frusemide, in a container not labelled identifying the contents and giving direction as to use, contrary to s85(3) and 91(2) of the Medicines Act 1968; the sale of five ampoules of diamorphine 10ml, a medicinal product which was not of the nature or quality demanded by the purchaser in that it was out of date, contrary to s64(1) of the Medicines Act 1968.

3. An inquiry into a complaint by the Council of the Society against Korush Jalali Farahani (registration number 1067185), which alleges that the theft of a number of codeine phosphate tablets from a pharmacy while working as a locum pharmacist, the possession of 14 Kapake capsules which had not been prescribed for him, and the consumption of codeine phosphate tablets and Kapake capsules while working as a locum pharmacist may amount to misconduct. The committee will also consider a conviction for the theft of 40 codeine phosphate 30mg tablets and 14 zolpidem tartrate 10mg tablets of a value unknown belonging to Superdrug Plc, contrary to Sections 1(1) and 7 of the Theft Act 1968.

4. An inquiry into a complaint by the Council of the Society against Julia Ruth Harrison (registration number 85697) and James Dyan Laurence (registration number 84262), which alleges that a failure to have in place a suitable system for the delivery of medicines, the supply of prescription-only medicines without the authority of valid prescriptions, and having in place a system which permitted the supply of prescription-only medicines to patients in circumstances where the prescriptions had not been signed by the time of supply may amount to misconduct.

5. The committee will deliver the determination of the inquiry into a complaint by the Council of the Society against Manherlal Keshavlal Shah (registration number 63471) and MAM International Ltd (identification number 1001688), which alleged that the supply of out-of-date medicines, the supply of enalapril tablets on which there was no expiry date or batch number, a failure to implement adequate systems for the removal of out-of-date medicines, the presence in the dispensary of medicines where the date of expiry and batch number were not present and/or had been removed, the presence in the dispensary of medicines labelled years previously from other pharmacies for various patients which were stored among the other, alphabetically arranged, current stock, indicating that they might be reused, and the presence of a number of European products which did not bear a produce licence number may have amounted to misconduct.

6. An inquiry into the case of Francis Smialowski (registration number 70425), who has been convicted of four counts of dishonestly obtaining money transfers by deception, namely, by representing that he had carried out work outside of normal working hours for which he was entitled to claim payment, contrary to Section 15a(1) and (5) of the Theft Act 1968.

7. An inquiry into the case of Daniel Charles Jenkins (registration number 76428), who has been convicted of driving a motor vehicle after consuming so much alcohol that the proportion of it in his breath exceeded the prescribed limit, contrary to Section 5(1)(a) of the Road Traffic Act 1988.

8. The Committee will deliver the full determination, with reasons, of the inquiry into a complaint by the Council of the Society against Ruxana Munshi (registration number 82341). The committee delivered part of its determination on 25 May 2006, when it issued Ms Munshi with a reprimand.
