Statutory Committee decisions

Set out below are the outcomes of inquiries heard before the Statutory Committee of the Royal Pharmaceutical Society of Great Britain on Monday 26 June, Tuesday 27 June, Wednesday 28 June and Thursday 29 June 2006.

1. The resumed inquiry into a complaint by the Council of the Society against Richard Gregory Woodroffe (registration number 68919), Margaret Mary Rita Gorman (registration number 67793) and Alan Woodcock Ltd (company identification number 1001329) was adjourned for the committee to deliver its determination at a later date.

2. Following the inquiry into a complaint by the Council of the Society against Dinesh Parmar (registration number 74869), the committee resolved to direct the removal of Mr Parmar’s name from the Register. The committee found proved the Council’s allegation that the repeated supply of laxatives and/or diuretics to a patient who Mr Parmar knew, or ought to have known, was vulnerable to abuse those medicines, the failure to ensure that the pharmacy premises were safe for the public and/or persons working there, the failure to ensure that all stock was stored appropriately and the failure to heed the advice of a Society inspector, amounted to misconduct. The committee also found proved the following convictions: the supply of a medicinal product, namely furosemide, without a prescription given by an appropriate practitioner, contrary to Sections 58(2)(a) and 67(2) of the Medicines Act 1968; the supply of a medicinal product, namely furosemide, in a container not labelled identifying the contents and giving direction as to use, contrary to Sections 85(3) and 91(2) of the Medicines Act 1968; the sale of five ampoules of diamorphine 10ml, a medicinal product which was not of the nature or quality demanded by the purchaser in that it was out of date, contrary to Section 64(1) of the Medicines Act 1968. Under Section 11 of the Pharmacy Act 1954, the direction to remove Mr Parmar’s name from the Register is not to take effect until the expiration of a period of three months from the date on which notice of removal was given or in a case where an appeal has been brought against the direction, until the appeal is determined or withdrawn.

3. The inquiry into a complaint by the Council of the Society against Korush Jalali Farahani (registration number 1067185) was adjourned for three months.

4. Following the inquiry into a complaint by the Council of the Society against James Dyan Laurence (registration number 84262) and Julia Ruth Harrison (registration number 85697), the committee resolved to issue Mr Laurence with an admonition and to take no further action against Ms Harrison. The committee found proved, in relation to Mr Laurence, the Council’s allegation that a failure to have in place a suitable system for the delivery of medicines, the supply of prescription-only medicines without the authority of valid prescriptions, and having in place a system which permitted the supply of prescription-only medicines to patients in circumstances where the prescriptions had not been signed by the time of supply, amounted to misconduct.

5. Following the inquiry into a complaint by the Council of the Society against Manherlal Keshavlal Shah (registration number 63471) and MAM International Ltd (company identification number 1001688), the committee resolved to direct the removal of Mr Shah’s name from the Register and to take no further action against MAM International Ltd. The committee found proved the Council’s allegation that the supply of out-of-date medicines, the supply of enalapril tablets on which there was no expiry date or batch number, a failure to implement adequate systems for the removal of out-of-date medicines, the presence in the dispensary of medicines where the date of expiry and batch number were not present and/or had been removed, the presence in the dispensary of medicines labelled years previously from other pharmacies for various patients which were stored among the other, alphabetically arranged, current stock, indicating that they might be reused, and the presence of a number of European products which did not bear a product licence number, amounted to misconduct. Under Section 11 of the Pharmacy Act 1954, the direction to remove Mr Shah’s name from the Register is not to take effect until the expiration of a period of three months from the date on which notice of removal was given or in a case where an appeal has been brought against the direction, until the appeal is determined or withdrawn.

6. The inquiry into the case of Francis John Smialowski (registration number 70425) was stayed following the direction of the chairman.

7. Following the inquiry into the case of Daniel Charles Jenkins (registration number 76428), who had been convicted of driving a motor vehicle after consuming so much alcohol that the proportion of it in his breath exceeded the prescribed limit, contrary to Section 5(1)(a) of the Road Traffic Act 1988, the committee resolved to take no further action.
