Statutory Committee decisions

Set out below are the outcomes of recent inquiries heard before the Statutory Committee of the Royal Pharmaceutical Society of Great Britain on Monday 22 January, Tuesday 23 January and Wednesday 24 January 2007.

1. Following the inquiry into a complaint by the Council of the Society against Ramanlal Ambaram Mistry (registration number 74751) and Mistry Pharmacy Ltd (identification number 1084440), the committee directed the removal of Mr Mistry’s name from the Register. The committee found proved the allegation that: dispensing to a patient atenolol tablets labelled as amitriptyline in response to a prescription calling for amitriptyline hydrochloride; dispensing to a patient doxazosin labelled as tolterodine in response to a prescription calling for tolterodine; dispensing to a patient ramipril capsules labelled as lisinopril tablets in response to a prescription calling for lisinopril tablets; causing or permitting atenolol tablets that had previously been dispensed to be returned to dispensary stock; causing or permitting additional medicines that had previously been dispensed to patients to be returned to dispensary stock; and causing or permitting, through a failure to appoint a superintendent pharmacist between 1 April 2000 and 4 July 2005, the company to carry on a retail pharmacy business unlawfully during that period, amounted to misconduct. Under Section 11 of the Pharmacy Act 1954, the direction to remove Mr Mistry’s name from the Register is not to take effect until the expiration of a period of three months from the date on which notice of removal was given or in a case where an appeal has been brought against the direction, until the appeal is determined or withdrawn. The Committee further directed that no further action should be taken against Mistry Pharmacy Ltd.

2. Following the inquiry into the case of Cyril Clement Daniel Siou (registration number 85068), the committee resolved to reprimand Mr Siou. Mr Siou had been convicted of having between 22 March 2001 and 28 May 2002, in the course of a business carried on by him, assembled medicinal products including ephedrine hydrochloride and sildenafil citrate other than in accordance with a licence granted for the purposes of Section 8 of the Medicines Act 1968, contrary to Section 8 of the Medicines Act 1968.

3. Following the inquiry into a complaint against Lyndon Lien Sun Wou (registration number 67470), the committee resolved to reprimand Dr Wou. The committee found proved the allegation that the use of abusive and threatening language and behaviour towards two assistants and the failure to deal appropriately with a patient’s request to dispense her medication amounted to misconduct.

4. The committee adjourned the inquiry into a complaint by the Council of the Society against Anilkumar Ishverbhai Patel (registration number 70633) and Hemantika Anil Patel (registration number 71179) to deliver their determination at a later date.

5. The committee adjourned the application for restoration on behalf of Hasmukhkant Nanji Badiani.
