Statutory Committee decisions
Set out below are the outcomes of inquiries heard before the Statutory Committee of the Royal Pharmaceutical Society of Great Britain on Tuesday 20 February, Wednesday 21 February and Thursday 22 February 2007:
1. Following the inquiry into a complaint by the Council of the Society
against Stephen Shaw (registration number 74695), the committee directed
the removal of Mr Shaw’s name from the Register. The committee
found proved the allegation that the creation and submission of two false
references to a locum agency for the purposes of seeking employment as
a pharmacist through that agency amounted to misconduct. Under Section
11 of the Pharmacy Act 1954, the direction to remove Mr Shaw’s
name from the Register is not to take effect until the expiration of
a period of three months from the date on which notice of removal was
given or where an appeal has been brought against the direction, until
the appeal is determined or withdrawn.
2. Following the inquiry into a complaint by the Council of the Society against
Rosalie Mary Pattison (registration number 66575), the committee directed the
removal of Mrs Pattison’s name from the Register. The committee found
proved the allegation that taking for the purposes of self-medication and/or
for unknown purposes, dishonestly and without the authority of a prescription,
dihydrocodiene tablets, loperamide tablets, diazepam 5mg and 10mg tablets,
omeprazole tablets, and Sudafed Plus tablets belonging to her employer, amounted
to misconduct. Under Section 11 of the Pharmacy Act 1954, the direction to
remove Mrs Pattison’s name from the Register is not to take effect until
the expiration of a period of three months from the date on which notice of
removal was given or where an appeal has been brought against the direction,
until the appeal is determined or withdrawn.
3. Following the inquiry into a complaint by the Council of the Society against
Anilkumar Ishverbhai Patel (registration number 70633) and Hemantika
Anil Patel (registration number 71179), the committee directed the removal of Mr Patel’s
and Mrs Patel’s names from the Register. The committee found proved the
allegation that the alteration of the dosage instructions for a patient without
seeking the prescriber’s authorisation; the making of a deliberately
false record in the pharmacy diary of a conversation with a doctor; the failure
to take proper or sufficient steps in response to an enquiry from the above
patient’s mother regarding the change of dosage; a number of dispensing
errors; the failure to take proper or sufficient steps in response to dispensing
errors; deliberately misleading a patient regarding the cause of the dispensing
errors; deliberately making a false entry in the pharmacy diary in relation
to the above; a number of labelling errors; the supply of a Controlled Drug
other than in accordance with the Misuse of Drugs Regulations 2001; a failure
to supply Piriton syrup without an explanation and misleading a patient with
regards to this failed supply; the failure to supply the correct quantity of
medication in circumstances where no owing slip was supplied; the making of
inaccurate records in the patient medication record; a failure to have adequate
systems in the pharmacy; the pharmacy’s supply of sugar-free methadone
in response to prescriptions calling for methadone; a failure to heed the advice
of the Society’s inspector in relation to extemporaneous production of
methadone and to the use of medicinal products which did not bear any marketing
authorisation; the use of unlicensed senna to dispense prescriptions; the failure
to ensure that dates of opening were recorded on medication with limited shelf-life;
the presence in the dispensary of loose capsules and loose and cut blister
strips and capsules of unknown provenance and a failure to heed the advice
of the Society’s inspector in this regard; the presence in the dispensary
of manufacturers’ boxes containing strips of tablets and capsules some
of which had no batch numbers and/or expiry dates; the presence in the dispensary
of manufacturers’ boxes containing strips of tablets and capsules of
a brand differing from those marked on the manufacturer’s box and a failure
to heed the advice of the Society’s inspector in relation to the above;
and the presence in the storage area of empty medicine bottles available for
use which were uncapped and vulnerable to contamination, amounted to misconduct.
Under Section 11 of the Pharmacy Act 1954, the direction to remove Mr Patel’s
and Mrs Patel’s names from the Register is not to take effect until the
expiration of a period of three months from the date on which notice of removal
was given or where an appeal has been brought against the direction, until
the appeal is determined or withdrawn.
4. Following the application for restoration to the Register on behalf of Hasmukhkant
Nanji Badiani, the committee directed that Mr Badiani should be restored to
the Register.
5. The committee adjourned the inquiry into Neil Hutchinson (registration number
79982) and Carol Janette Hutchinson (registration number 79981).
