Disciplinary Committee decisions

The Disciplinary Committee met on Wednesday 11, Thursday 12 and Friday 13 July 2007 and made the following directions:

1. Following an application for restoration on behalf of Yui Pui Tsang (previous registration number 81506), the committee directed that Mr Tsang’s name should be restored to the Register.

2. Following an application for restoration on behalf of Bhupinder Singh Bharj (previous registration number 72660), the committee directed that Mr Bharj’s name should be restored to the Register with the following conditions: to comply with the Society’s CPD programme, to work under the supervision of a pharmacist for six months and to provide a reference from the supervisor, and to produce evidence of completion of a return to practice course. These conditions will be subject to review within nine months.

3. Following an inquiry into Mazair Iqbal (registration number 85616), under the Statutory Committee rules, the committee directed the removal of Mr Iqbal’s name from the Register. The Committee found proved a conviction on 11 November 2004 at Dudley Magistrates’ Court for (i) making a false instrument, namely a document purporting to be an Official Copy of the Land Registry entry for 86 High Street, Pensnett, Dudley DY5 4ED with the intention of using it to induce the Secretary of State for Health to accept it as genuine and by reason of so accepting it, to do or not to do some act of his own or any other person’s prejudice, contrary to Sections 1 and 6 of the Forgery and Counterfeiting Act 1981; and (ii) using a false instrument, namely a document purporting to be an Official Copy of the Land Registry entry for 86 High Street, Pensnett, Dudley DY5 4ED, with the intention of inducing the Secretary of State for Health to accept it as genuine and by reason of so accepting it, to do or not to do some act of his own or any other person's prejudice, contrary to Sections 3 and 6 of the Forgery and Counterfeiting Act 1981. The committee directed that no further action should be taken in relation to an allegation of misconduct. Under Section 11 of the Pharmacy Act 1954, the direction to remove Mr Iqbal’s name from the Register is not to take effect until the expiration of a period of three months from the date on which notice of removal was given or where an appeal has been brought against the direction, until the appeal is determined or withdrawn.
