Disciplinary Committee decisions

The Disciplinary Committee met on Monday 5, Tuesday 6, Wednesday 7 and Thursday 8 November 2007 and heard the following inquiries under Statutory Committee rules (as provided for in the Pharmacists and Pharmacy Technicians Order 2007).

1. Following the inquiry into the case of William John Carcary (registration number 1068883) the committee adjourned the inquiry for one year.

2. Following the inquiry into the case of James Asher (registration number 1078163) the committee directed the removal of Mr Asher’s name from the Register. The Committee found proved the allegation that taking flurazepam from patient-returned medicines for his own use and supplying a Controlled Drug and prescription-only medicines to another in circumstances other than when acting in his capacity as a pharmacist, amounted to misconduct. The committee also found proved convictions at George Street Magistrates’ Court, Lancaster, on 31 October 2005 for (i) supplying a quantity of diazepam, a CD, in contravention of s4(1) of the Misuse of Drugs Act 1971 and (ii) supplying a quantity of flurazepam, a CD, in contravention of s4(1) of the Misuse of Drugs Act 1971. Under Section 11 of the Pharmacy Act 1954, the direction to remove Mr Asher’s name from the Register is not to take effect until the expiration of a period of three months from the date on which notice of removal was given or in a case where an appeal has been brought against the direction, until the appeal is determined or withdrawn.

3. Following the inquiry into the case of Gary George Fisher (registration number 77584) the committee directed the removal of Mr Fisher’s name from the Register. The committee found proved a conviction at Bristol Crown Court on 17 March 2006 for conspiracy to supply a class A Controlled Drug, namely cocaine. Under Section 11 of the Pharmacy Act 1954, the direction to remove Mr Fisher’s name from the Register is not to take effect until the expiration of a period of three months from the date on which notice of removal was given or in a case where an appeal has been brought against the direction, until the appeal is determined or withdrawn.
